1. How To Enter: To enter the Herbert Automotive Free Gas for a Year Giveaway (“Giveaway”) log on to https://www.herbertauto.com/freegas/ to complete and submit electronically an official entry form to receive one (1) entry in the drawing.
Only one entry per person is allowed. Multiple entries submitted by a single entrant are void. The use of script, macro, automated entry or similar devices or any other devices that subvert the entry process to participate is prohibited and all entries through such devices are void. Entrants must fully complete and submit all non-optional information requested to be eligible. Non-optional information that will be gathered is a telephone number and email. This will also be the only way the winner will be communicated with. All entries and any other submitted materials become the property of Grease Monkey International, LLC (“Herbert Auto” or “Sponsor”) and none will be returned. Herbert Auto is not responsible for transactions or entries that are lost (for any reason including computer, telephone, human or other error or omission), incomplete, inaccurate, interrupted, stolen, deleted, delayed, garbled, mutilated, damaged, illegible, late or misdirected or that are processed, reported undeliverable or transmitted incorrectly; or for printing, typographical or other errors appearing within these Official Rules, in any Giveaway-related advertisements or other materials; or for other errors or problems of any kind whether mechanical, technical, human, telephonic, network, electronic wireless or otherwise relating to or in connection with the Giveaway, including, without limitation, errors or problems which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the prize, the inability to access any website associated with this promotion or process any transaction thereon or for inaccurate transmissions or failure to receive entry information on account of technical problems, traffic congestions on the Internet or any combination thereof. Any such entries will be void.
Sponsor will collect personal data from entrants when they enter this Giveaway. By entering this Giveaway, each entrant gives their express permission to be contacted by Herbert Auto and/or Administrator (as defined below) by telephone, email and/or postal mail for Giveaway purposes only. In addition, online entrants will be given the ability to opt-in to receive future email, updates, offers and promotional materials from Herbert Auto; however, eligibility to participate in the Giveaway is not dependent upon entrant’s consent to receive such emails and consenting to receive such emails does not impact entrant’s chances of winning. Only entrants who opt-in will receive such offers. Information collected from an entrant is subject to Sponsor’s privacy policy which can be found at https://www.herbertauto.com/privacy-policy/.
2. Giveaway Period: The Giveaway begins at 8:00:01 a.m. AM MT Nov 16, 2025 and ends at 11:59:59 p.m. MT Nov 30, 2025 (“Giveaway Period”). All entries submitted online must be received by 11:59:59 p.m. MT Nov 30, 2025.
3. Winners Selection and Notification: On or about December 1, 2025 Sponsor will conduct a random drawing from among all eligible entries received to award the prize outlined below. The winner will be notified by Herbert Auto on or about December 8, 2025 via phone, mail and/or email. The potential winner is required to sign an affidavit of eligibility/liability that must be returned to Herbert Auto within five (5) business days of the date of the notification. If a winner is ineligible, fails to respond within the deadline, or if the prize or prize notification is returned as undeliverable, the prize will be forfeited and an alternate winner selected. Each entrant agrees that Herbert Auto has the sole right, authority and discretion to determine the winner of the Giveaway and to resolve all matters or disputes arising from the Giveaway and that their determination is final and binding.
In the event of a dispute as to the identity of any online entrant based on an email address, entrant will be deemed to be the “authorized account holder” of the email address submitted at the time of entry provided he/she is eligible according to these Official Rules. “Authorized account holder” of the email address is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization (e.g., a business, educational institution, etc.) which is responsible for assigning email addresses for the domain associated with the submitted email address. In the event a winning “Authorized account holder” is a joint account, a total of one (1) prize will be awarded in the names of the joint account holders. Proof (to Administrator’s satisfaction) of being the authorized account holder may be required by Herbert Auto. Herbert Auto reserves the right to modify prize award procedures.
4. Estimated Odds: Odds of winning depend upon the total number of eligible entries received.
5. Prize: One (1) Grand Prize. One (1) winner will receive the estimated value of one year of unleaded regular gasoline awarded in the form of a check in the amount of $2,500.00. Free Gas for a Year prize amount is based on the average number of gallons of gas used of 663 gallons in a year for passenger vehicles and an average price per gallon of $3.27 (as of May 2024), plus an additional amount. The average number of gallons of gas used in a year is calculated by the average number of miles driven per year of 16,172 (as of February 2024) and the average amount of miles in a gallon for a vehicle in the car category of 24.40 (as of January 2024). The winner may receive more or less than one year’s worth of equivalent gas depending on the winner’s vehicle, gas usage, and the location and prevailing price at the time of refueling. Approximate Retail Value (“ARV”) per prize: $2,500.00.
No prize substitutions, cash equivalent or transfer of prizes permitted, except by Herbert Auto which reserves the right, at its sole discretion, to substitute a prize (or portion thereof) of comparable or greater value. Only the prize claimed in accordance with these Official Rules will be awarded. Only the advertised number of prizes will be awarded in accordance with the criteria above.
Any prize details not specified above will be determined by Herbert Auto, in its sole discretion.
6. Eligibility: You are not authorized to participate in the Sweepstakes if you are not located within the fifty (50) United States, the District of Columbia or in Puerto Rico and are AT LEAST 18 YEARS OLD AT TIME OF ENTRY. Employees of Herbert Auto, its parent corporations, subsidiaries, affiliates, agents, licensees, franchisees, prize suppliers, and advertising and promotion agencies, including Administrator and the immediate families (spouses, parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the households, whether related or not, of the above are not eligible to enter or win. Void where prohibited law, rule or regulation. The Giveaway is subject to all applicable federal, state and local laws and regulations. The sweepstakes winner will be required to provide a copy of his/her Identification to Herbert Auto to prove identity and resident status. Entrants must comply with these Official Rules. By participating, an entrant agrees to be bound by these Official Rules.
7. Conditions of Entry:
a. Execution of Affidavit by the Winner: By entering, each entrant agrees that, if selected as a winner, he/she will sign an affidavit attesting to being a resident in the United States, and at least eighteen (18) years of age, and provide information, including Social Security Number, that Sponsor deems necessary to complete the required tax documentation. By entering, entrants give their express permission to be contacted by Herbert Auto by mail, email and/or telephone relating strictly to the Giveaway.
b. Disqualification: Herbert Auto reserves the right, in its sole discretion, to disqualify any entrant who fails or refuses to comply with these Official Rules, who enters or attempts to enter the Giveaway, in any manner, or through any means, other than as described in these rules, or who disrupts or attempts to disrupt the Giveaway or circumvents any of these Official Rules.
c. Taxes and Other Expenses: All liability for all federal, state, local and other taxes imposed on the prize and for any other expenses and costs not specifically described herein is the sole responsibility of the winner. By entering, each entrant agrees that, if selected as a winner, he/she will provide Herbert Auto with all information required for Herbert Auto to complete the appropriate tax forms and related documents (if any), including, without limitation, a W9 form.
d. Compliance with Laws: All federal and state and local laws and regulations apply.
e. Termination: Herbert Auto reserves the right to terminate the Giveaway for any or no reason, at any time, prior to the entry deadline, or to modify, suspend or terminate the online portion of the Giveaway if infected with a computer virus or is otherwise technically impaired.
f. Applicable Law: All entrants agree that the law of Colorado, the state of Herbert Auto’s corporate office, shall apply exclusively to the Giveaway and that any dispute with respect to the Giveaway shall be resolved in either federal or state courts located in Arapahoe County, Colorado.
g. Entire Agreement; Severability: These Official Rules constitute the entire agreement between the Sponsor and each entrant. If any provision of these Official Rules is held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
8. Promotion: If the winner wishes to be involved in any advertising or promotional purposes related to the Giveaway, the winner must grant permission to Herbert Auto and its agents and licensees, without further compensation, to the use of the entrant’s name, voice, photograph/likeness and any other information provided in entrant’s entry for advertising and promotional purposes, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet), except where prohibited by law. Providing consent has no impact on an entrant’s chance of winning. Herbert Auto shall not ask for such consent until after the winner is determined. Herbert Auto will not and cannot disqualify a winner for not providing consent.
